JUDGE CLAASSEN BETRAYED THE LAW, BY FAILING IN FOUR (4) AREAS, TO ADHERE TO COURT PROTOCOL & JUDICIAL PROCEDURE; I EXPOSE HIS MISCONDUCT IN (CHAIT vs. RUMBAK Johannesburg High Court Case No. 97/20452 10 November 1998) – OBSTRUCTION OF JUSTICE, AND AN UNLAWFUL TRIAL: Judge Claassen failed due process by refusing to allow me to refer to Dr Rumbak’s THREE (3) other victims [3 at that juncture in time], which is relevant corroborative evidence, in The Public Interest: The Public has a Right to Know The Truth (Advocate Brian Spilg motivated an out-of-court arrangement for one of Dr Rumbak’s victims); Judge Claassen refused to allow me to demonstrate to the court mouth-damage when I chew; Judge Claassen allowed Dr Rumbak’s advocate - John Suttner (with a nervous shoulder-tic) - to ask a ‘leading question’: [“are you telling the court there are only five ‘straight’ doctors in South Africa - all the rest are ‘crooks’?”, when I referred to two doctors’ lies & false medical-certificates, resulting in Steve Biko’s murder-case being forced open by five ‘straight’ doctors (see below)]. Andre Brink “A Fork in the Road” pg.428: “there are judges of the Supreme Court under investigation for receiving hundreds of thousands of rand in private payments for ‘services rendered’… this constitutes a threat to the dignity & public acceptance of the integrity of the courts”; and on pg.235: “the trial was in the hands of a right-wing judge, clearly kowtowing the apartheid regime”… Dr David Klatzow “Justice Denied” pg.66 “Justice is the key thread that holds the cloth of freedom together and, as such, it must be fiercely protected by each and every one of us”. “He cried out for justice, when justice was ground under the heel of those whose duty was the maintenance of justice; he saw great wrongs done, and he tried to bring those great wrongs into the light of day, that all men might look upon them; but the forces of civic justice were intimidated by the threats of cornerboys & hooligans grown into great men; the law became what it is: a bitter joke, at which only the devil laughs… you have here, a city made filthy, and cruel, and corrupt” (pg.297 Anthony Burgess “Earthly Powers”) “Our justice-system was one of the best in the world, but it has become dysfunctional and chaotic in the last decade or so, say those with knowledge of the law” (Die Burger 18 October 2018) Judicial Services Commission MUST remove old, arrogant, aggressive, hostile, blatantly-biased apartheid-mentality judges, who mete out what Americans call “a purchased verdict”… 4. ROHAN BARRY ISAACS – Dr Rumbak’s cagey-lawyer, representing Deneys Reitz attorneys – intimidated my chief-witness, who then refused to testify; Isaacs fingered my sanity, after disrupting an Economics Lecture I was giving: Isaacs terrorised me with threats “to serve orders to compel” me into evaluation by his well-briefed hired-gun medical-team, with their false reports of “pre-existing conditions in my imagination”; inter alia psychiatrist - Dr David Shevel – who concocted a FALSE medical report. Isaacs also instructed me to have a CAT-scan (brain X-ray), subjecting me to “radiation sickness”: the report points to Trigeminal Nerve Damage in the area where Dr. Rumbak butchered my mouth. Isaacs aimed to fragment my life. 5. RONALD BOBROFF - my 1st lawyer – played for time, using delaying tactics, then refused to be my attorney-of-record, with the pretext that my “case against Dr Rumbak is too expensive, too complex, and would take too long”; when Bobroff eventually released my file, vital X-rays which point to mouth-damage caused by Dr Rumbak were held back; Bobroff is being investigated by The Hawks, with international Interpol Red Notices arrest warrants for extradition; he stole millions of Rands; he was law society president, struck off The Roll (Sunday Times 29 July 2018); “the law society incurred Judge Ranchod’s wrath this week, for its tardiness in acting against its former president, Ronald Bobroff” (Sunday Times 23 July 2017). Bobroff is fugitive in Australia, with pending extradition to South Africa to face trial, after overcharging road-accident victims; his bank accounts in Israel have been frozen (S.A. Jewish Report 18-25 August 2017 & Cape Argus 12 August 2017). Appointing lawyers as guardians of TRUTH, is comparable to wolves protecting sheep! 6. PETER SOLLER - my 2nd lawyer - sent me Death Threats, and purposely spoilt my case against Dr Rumbak, and was struck off The Roll by Judges Bertelsmann & de Villiers, who stated that “Soller is a danger to society”; the law society protected Soller at bogus investigations; disciplinary head, Mr du Plessis, threatened “to have me removed, if I do not keep quiet”. What is the law society going to do with Dr Rumbak’s lawyer, Rohan Barry Isaacs? Justice Minister Ronald Lamola is urged to investigate & expose criminally-corrupt legal procedures which obstruct justice, medical fraud, and false medical-reports issued by a collusive & conspiring medical-mafia-gang of ‘private-practice’ doctors. 7. MAE NAVIAS, an octogenarian social-worker, who wormed her way back as ‘consultant’ - together with Bernard David, an advocate-wearing-a-skullcap, joined ‘the conspiracy–of-silence’ - stands accused of putting a dagger in my soul, by plotting to have me evaluated at a psychiatric facility, which is mental torture: David said “it would strengthen my case” (who will be felled by this logic?); failing that, Navias blackmailed me into evaluation by Dr Gunther Winkler; Winkler was curious to know how I remain “positive, motivated & strong”, then prescribed anti-psychotic poisons – haloperidol & benzhexol – which cause stiffness, shaking & sudden Death: this is the behaviour of a Nazi murderer; Dr Winkler tried to persuade me to submit an application form (which he had already filled out) for a disability grant on the grounds of a ‘psychiatric delusional disorder’; I label this low-class, crass gambit as despicably-devilish. At a Religious Ceremony on 29 November 2011, Mae Navias pleaded that she is “an old lady, and wants me to forgive & forget, and to make Peace”. World Health Organisation (W.H.O.) is investigating South Africa’s private health system, which is expensive by international standards (Business Day 4 August 2016). CONGRATULATIONS also to Minister of Health, Dr Aaron Motsoaledi, for cracking the apartheid-installed Health Professions Council, and getting 2 unco-operative heads to roll. It’s about time to disband this ante-diluvian, fossil structure, to end private health, and to bring on National Health Insurance (N.H.I.). Dr Motsoaledi is also “accusing heads of state hospitals, who alert lawyers of possible medical negligence claims, and bribe them” (Rapport 15 Maart 2015). He wants victims of medical negligence to be compensated for damage. Medical Aid benefits for someone who has served the state for 40 years, ends on retirement. A person whose life depends on an oxygen-supplement, will die because maximum claim is reached, and the medical aid will not foot further bills… THESE ARE JUST 2 EXAMPLES OF A SICK SYSTEM! The Truth I taught for 21 years - the strongest force in the world - now becomes a lesson for lying lawyers & doctors who give false medical reports. With all their wealth, they cannot duck & dive facts & logic… Constitutional Court Judge Edwin Cameron – in his book “Justice” – gives examples of hostile & biased judges: I prove FOUR (4) areas where Judge Claassen was blatantly biased in favour of Dr Rumbak and hostile against me. Some doctors are paid to lie in their reports: daggers of ‘delusional disorders’ backfire. Minister of Justice, Adv. Michael Masutha, must investigate how the corrupt South African justice system supports doctors, and victimises victims of medical malpractice… Before they place me and Dr Rumbak - as Jews - into prescribed plain pine coffins, I will have taught Dr Rumbak that he will not bury this botch-up! Painful, cracking jaws is a daily reminder to fight on, while Dr Rumbak pays his mafia for protection: lawyer Rohan Barry Isaacs represents Deneys Reitz attorneys, instructed by Medical Protection Society (Dr Rumbak’s insurers), underwritten by Lloyds of London. High Court Judge Claassen was arrogant, aggressive, hostile and blatantly biased; the law society protects rogue lawyers; the health professions council protects negligent doctors; the health department has NO control over Dr Rumbak, because he pays for privileges to be untouchable ‘in private practice’ ! As victim, I am felled, because the power of money strangles Truth, Justice & Human Rights… If society stands silent, allowing a dangerous doctor with a medical negligence-history freedom to practise, there’s a critical need for a wake-up call to hold him responsible & accountable for his trail of botch-ups… My great honour now - which overrides post-graduate Economics Research - is alerting the world that there is NO justice for medical negligence victims in South Africa. Icon-Hero Nelson Mandela was locked away, because the apartheid government was afraid of The Truth. To honour Madiba’s credo “it seems impossible, until it’s done”, I will plod on, driven by A Calling to prove (beyond reasonable doubt) that the South African justice system favours the rich, and Truth does not count in court...  DR JULIAN M. RUMBAK is sheltered by MEDICAL PROTECTION SOCIETY… District Surgeon’s & Doctors’ Reports are PROOF AND INCONTROVERTIBLE EVIDENCE, confirming permanent mouth-damage: Dr Rumbak has damaged THREE other patients (post-operative infection, post-operative sinus problems & incorrect crown fittings); in ONE case, adv. Brian Spilg forced him to admit guilt, with “an out-of-court arrangement”. The presiding judge – Claassen - would NOT permit demonstrating to the court mouth-damage when I chew; he would NOT allow me to spell out damage-details relating to Dr Rumbak’s THREE other victims, which is Relevant Corroborative Evidence, In The Public Interest (The Public has a Right to Know); he shouted at me, and (wrongly) allowed adv. John Suttner (with a nervous shoulder-tic) to ask a ‘leading question’: [“are you telling the court there are only five ‘straight’ doctors in South Africa - all the rest are ‘crooks’?”, when I referred to two doctors’ lies & false medical certificates, resulting in Steve Biko’s murder-case being forced open (see below)]. These are pointers to public abuse of legal rules, contrary to proper court procedure: a failed justice system… This same judge treated a burnt-vagina victim with contempt, awarding a negligible pittance; the doctor implicated fled South Africa! The government has an obligatory duty to act NOW!  Judicial Services Commission MUST remove old, arrogant, aggressive, hostile & blatantly-biased, apartheid-mentality judges, who mete out what Americans call “a purchased verdict”…  Dr Rumbak’s defamatory character-assassination report states that I am “an Economics lecturer; a bachelor with psychological problems, living in a Yeoville flat, playing the piano in bars”. (Uncanny that Dr Rumbak wanted to book me into hospital - for a general anaesthetic - to remove splintered tooth-roots). For the record, my Economics students achieved highest marks in national examinations on THREE occasions; I played The Tusk Bar’s piano at The Palace at Sun City, provided piano-music for Cape Judges at The Five Flies Restaurant, and was pianist during The King of Jordan’s wine-estate visit: This is TRUTH, and not a ‘delusional disorder’, as per Dr David Shevel’s report (see below). By butchering my mouth, Dr Rumbak has stolen my lecturing career; Dr Rumbak has stolen my ability to talk normally; Dr Rumbak has stolen my ability to chew without pain. I am left abandoned, with a grossly-distorted face. A lecturer with a broken mouth, is like a prostitute without a bed: it’s “the tool-of-the-trade”! NATIONAL HEALTH INSURANCE (N.H.I.) must control & regulate ALL doctors, so that ‘private-health’ criminal corruption & fraud is aborted. I uncover a medico-legal conspiracy-of-silence with closing-of-ranks. I brazenly defied agendas to Death-medicate me (which backfired)…  HEALTH DEPARTMENT HAS NO CONTROL OVER DR RUMBAK, because he pays for privileges in ‘private practice’, meaning that corrupt, fraudulent & criminal private health is given carte blanche free reign! This laager-mentality (blinkered reasoning) sanctions vestiges of the barbaric, antediluvian apartheid system, and is a perfect, paragon example of ‘the right of eminent domain’, where a doctor with a track-record of medical negligence, high blood-pressure, and questionable competency in carrying out delicate procedures, pays whatever it takes to be ‘untouchable’, and above-the-law, because he is in ‘private practice’! Where’s the logic? The ‘right of eminent domain’ is WRONG!  HEALTH PROFESSIONS COUNCIL – admitting its failed duty to protect The Public - is aware of Dr Rumbak’s medical negligence history & his character-assassination report: his file is kept in a dark-room! The world would have believed that freedom-fighter, Steve Biko, committed suicide because Dr Ivor Lang & Dr Benjamin Tucker lied, filling in false medical certificates to hide TRUTH. Five brazen doctors (Frances Ames, Professor Phillip Tobias, Trefor Jenkins, Edward Barker & Leslie Robertson) forced the health professions council to re-open the case, proving that Steve Biko was MURDERED by the apartheid security police. The toothless health professions council, whose ridiculous credo is “guiding the professions and protecting the public” MUST BE COMPELLED into an inquiry, by re-opening Dr Rumbak’s negligence history file! This council found Dr Rumbak ‘blameless’, without assessing my mouth-damage. On my insistence, elderly chairman Dr Dreyer, granted a meeting, but forbade my witnesses to testify; he referred to his own pains, which accompanies old age; my butchered mouth is a direct result of Dr Rumbak’s professional negligence. The South African medico-legal system backs negligent doctors; stubborn victims who take a stand, are suffocated into silence by a powerful mafia-network, which uses evil and subversive tactics: 1. Pre-existing condition, in the imagination: using false logic, doctors try to convince that my broken mouth (ie. trigeminal nerve-damage with neck-muscle spasm, jaw-joint damage and cartilage disruption) caused by Dr Rumbak’s butchered surgery, is a ‘delusional disorder’ – a madness! 2. Dispossessing the victim: they try to crack the victim into impotent bankruptcy 3. Paying for FALSE doctors’ reports, to change the physical damage caused by Dr Rumbak’s blatant professional negligence, into a mental illness 4. Pumping the victim with poisonous drugs, and trying to have him shut away in a mental institution… Kirk Douglas’ autobiography “The Ragman’s Son” - p.456 – points to a book Amos, by Stanley West… “Amos realises that a nursing home is being run by a greedy nurse, who is killing off the patients for the insurance”… MEDICAL PROTECTION SOCIETY (M.P.S.) - Dr Rumbak’s insurers for medical negligence - IS THE PRINCIPAL, ACCUSED & RESPONSIBLE FOR THE CRIMINAL ACTS OF AGENTS WHO USE EVIL TACTICS, AND MUST BE FORCED TO ACKNOWLEDGE ITS HEINOUS CONDUCT: • ROHAN BARRY ISAACS – Dr Rumbak’s cagey-lawyer, representing Deneys Reitz attorneys – intimidated my chief-witness & fingered my sanity, after disrupting an Economics Lecture I was giving: Isaacs threatened “serving an order compelling” me into evaluation by his paid-gun psychiatrist - Dr David Shevel – who concocted a FALSE medical report. The law society protected my lawyer - Peter Soller - at bogus investigations. Disciplinary head, Mr du Plessis, threatened “to have me removed, if I do not keep quiet”. Soller sent Death Threats, and purposely spoilt my case. Judges Bertelsmann & de Villiers struck him off the roll, stating that “Soller is a danger to society”! What is the law society going to do with Rohan Barry Isaacs? Appointing lawyers as guardians of TRUTH, is comparable to wolves protecting sheep! Justice Minister Michael Masutha is urged to investigate & expose criminally-corrupt legal procedures, medical fraud, and false medical reports issued by a collusive & conspiring medical mafia gang of ‘private-practice’ doctors. • MAE NAVIAS, a pensioned-off social-worker, who wormed her way back as ‘consultant’ - together with an advocate-wearing-a-skullcap - stands accused of putting a dagger in my soul, by plotting to have me evaluated at a psychiatric facility, which is mental torture; failing that, Navias blackmailed me into evaluation by Dr Gunther Winkler; he was curious to know how I remain “positive, motivated & strong”, then prescribed anti-psychotic drugs – haloperidol & benzhexol – which cause stiffness, shaking & sudden Death: this is the behaviour of a Nazi murderer. Dr Winkler tried to persuade me to submit an application form (which he had already filled out) for a disability grant on the grounds of a ‘psychiatric delusional disorder’. I label this low-class gambit as despicably devilish! Mae Navias – as an accomplice – is as guilty of planned murder as the accused, Dr. Gunther Winkler. At a Religious Ceremony on 29 November 2011, Mae Navias told me that she is “an old lady, and wants to make Peace”. My reply stands: “There will be Peace, after we face TRUTH”! Mae Navias finally stepped down on 28 February 2014.  Helen Zille - Democratic Alliance’s Cape premier - promised “to crack private-sector corruption, with zero tolerance”; her body-guard – Robert MacDonald - cross-examined me at the Civic Centre (as one would with a terrorist) when I presented my grievances relating to medico-legal corruption, fraud, and crime. Helen Zille must keep her “zero tolerance” promises “to crack private-sector corruption”, now that her party has garnered a majority percentage vote in the Western Cape…  Corruption Watch is too focused on public-sector corruption, allowing private-sector corruption to grow into a thriving cancer. THESE ARE ALL POINTERS TO A SOUTH AFRICAN MEDICO-LEGAL DISGRACE ! LET US HANG OUR HEADS IN SHAME ! Time for procrastination is over… If I accept lawyers’/doctors’ lies - together with their false medical reports, false-logic, and criminal agenda - it makes a mockery of THE TRUTH I taught for 21-years: I would be selling my soul to the devil – over my Dead body! A rabbi tried to explain away my ‘dangerous’ revelations as ‘private’, having ‘nothing to do with my religion’, advising me not to allow this to affect my health! Rabbi Dr Abraham J. Twerski teaches us that Truth=God: They Are Identities – an inseparable Siamese Twin! Implicated doctors – who are paid by Dr Rumbak’s legal team, to ‘create’ reports – are not hindered by the Laws of Logic & Truth. The way things stand, people who are maimed by South African doctors in private practice, are traumatised, terrorised, tortured, and tossed into the trash-can if they stand their ground! APARTHEID HEALTH leaves the Department of Health with NO control over doctors in private practice in South Africa, making it easy for these doctors to bury their mistakes.

APARTHEID HEALTH means that the Health Professions Council is paid to protect negligent doctors: they treat The Public with contempt; they are aware of Dr. Rumbak’s negligence history; his victims are intimidated into silence: in one instance, where a victim was represented by adv. Brian Spilg, Dr. Rumbak admitted guilt, and he agreed to foot costs.

APARTHEID LAW SOCIETY allowed Dr. Rumbak’s lawyer, Rohan Isaacs, free reign to intimidate me with threats of orders, compelling me into humiliating examination by doctors whom Isaacs paid to give reports denying the blatant damage caused by Dr. Rumbak, with pretexts of “pre-existing conditions in my imagination”.

Isaacs illegally intimidated my chief witness, who then refused to testify; he dispossessed and terrorised me.

The law society – at five hoax “investigations” - protected my lawyer, Peter Soller, who purposely spoilt my case.

Soller was then struck off the attorneys’ roll by two Judges.

APARTHEID JUSTICE means that in the High Court - CHAIT vs RUMBAK:

Judge Claasens was blatantly biased: he would not allow me to refer to the damage Dr. Rumbak caused to THREE other victims, which is important corroborative evidence.

Judge Claasens would not allow me to demonstrate to the court that I chew like a donkey, after Dr. Rumbak damaged my Trigeminal Nerve: muscles in my neck and cheek are in permanent spasm; he dislocated my jaw, and damaged my jaw-joints, which crack. I speak in discomfort.

Judge Claasens shouted at me, and he allowed adv. John Suttner to ask a “leading question”.

Dr. David Shevel was paid by Dr. Rumbak’s lawyer, Rohan Isaacs, to issue a report pointing to “delusions of grandeur”, because my Economics Students achieved Top Honours on three occasions in National Examinations. He slotted this TRUTH into a psychiatric ‘delusional disorder’, using false logic…

Dr. Gunther Winker read Dr. Shevel’s report, and prescribed anti-psychotic drugs: haloperidol and benzhexol, which cause stiffness, shaking, and sudden death…

The perfect strategy to get me silent!

Old social worker, May Navias - fingered my sanity – and tried to intimidate me into an evaluation at Valkenberg Mental Hospital. After a person enters the portals of a mental institution, a black mark with a sour stigma sticks for life, so that person loses all further credibility.

My Judaism commands me to do everything in my power to reduce this sick evil. With the approach of The Day of Atonement, I draw to the attention of the world, sins committed by the medical and legal fraternity, focusing on their combined efforts to shut this stubborn victim away.

My Candle of Truth burns on the eve of Yom Kippur.

This is my humble contribution, by opening a road for other victims of South African medical negligence.
